Article 1 - Definitions

  1. Environment: the vegan marketplace www.shoplikeyougiveadamn.com.
  2. Platform: the Environment on which products are offered to Users by third parties.
  3. Entrepreneur: Shop Like You Give a Damn B.V. who operates the vegan marketplace shoplikeyougiveadamn.com.
  4. User: every visitor to the Environment.
  5. Seller(s): a third party, being a legal or natural person who offers vegan products to Users via the Platform.
  6. Customer: a User of the Environment who proceeds to purchase a product via the Platform.
  7. Purchase Agreement: the agreement that is concluded between the Seller and a Customer due to the purchase of a product by the Customer from the Seller via the Platform.

Article 3 - Applicability

  1. These General Terms and Conditions apply to the order and purchase of products from Sellers via the Platform. These conditions can be consulted on the Surroundings of Shop Like You Give a Damn, see www.shoplikeyougiveadamn.com.
  2. Every Customer who places an order for a product offered by a Seller within the Environment, accepts the applicability of these Terms and Conditions.
  3. The provisions of these Terms and Conditions can only be deviated from in writing, in which case the remaining provisions will remain in full force.
  4. These Terms and Conditions apply to both buyers who can be classified as consumers and buyers who can be classified as business buyers.
  5. All rights and claims, as stipulated in these Entrepreneur Conditions and in any further agreements for the Entrepreneur, are likewise stipulated for the intermediaries and other third parties engaged by the Entrepreneur, explicitly including the Seller(s).
  6. Entrepreneur has the right to change these Terms from time to time. The amended conditions will apply as soon as they are published on the site. If a buyer subsequently places an order for a product as offered by a Seller, he thereby accepts the applicability of the amended Terms and Conditions. It is therefore advisable to consult these Terms and Conditions before placing an order for a Seller's product.
     

Article 4 - Customer account

  1. The Client must at least meet the following requirements:
    1. the Client is at least 18 years old;
    2. the Client can be reached by email;
  2. The Client can optionally register and create a client account on the Platform, but this is not an obligation to order products;
  3. Entrepreneur is at all times entitled not to process certain orders for items from Sellers or to attach conditions thereto.
  4. The Customer is responsible for the use made of his username and password. Entrepreneur advises the Client to use a unique password and to keep this password carefully confidential.
  5. The Client is not entitled to allow others to use his account.
  6. The Client declares to act in accordance with the Conditions and all applicable laws and regulations.
  7. The Customer is responsible for the accuracy of the data in his own account.
     

Article 5 - Third party offer

  1. The Client acknowledges that the purchase agreement is concluded between the Client and the Seller (the third party who offers the products for sale via the Environment) and that Entrepreneur is and / or does not become a party to this agreement.
  2. For questions and / or complaints about the products of Sellers purchased by the Customer, the Customer may at all times contact the relevant Seller directly or contact the Entrepreneur. The buyer hereby acknowledges that Entrepreneur is in no way liable, including but not limited to any defectiveness of the purchased product.
     

Article 6 - Order and delivery

  1. A Customer can place an order with the Entrepreneur via the ordering process for a product offered by a Seller.
  2. In most cases, the Customer receives a packing slip from the Seller in the packaging of the delivered product. If that is not the case, this packing slip can still be requested by contacting the Entrepreneur's customer service (support@shoplikeyougiveadamn.com).
  3. The ownership of the delivered items will only transfer if the Customer has paid everything that the buyer owes the Seller in respect of the order in question.
     

Article 7 - Reimbursement and payment

  1. The Customer owes the Entrepreneur the purchase price of the product purchased from the Seller via the Platform and is not discharged of his payment obligation by direct payment to the Seller. Payment by the Client can only be made to the Entrepreneur.
  2. The Seller has irrevocably granted the Entrepreneur the right to exercise the collection rights in the name of the Entrepreneur and to the exclusion of the Seller that ensue from the purchase agreement between the Customer and the Seller.
  3. Entrepreneur will handle claims against the Client in accordance with his normal collection policy.
     

Article 8 - Provisions for every purchase from Seller(s)

  1. If a Customer purchases a product through the Platform from a Seller then:
    1. The Client undertakes to read and agree to the general terms and conditions of sale of the relevant Seller(s) from whom he purchases one or more products via the Platform. These can be consulted at any time via the relevant Seller page on the Platform;
    2. An order for a product will then be processed in accordance with the provisions of the general terms and conditions of sale of the relevant Seller;
    3. The Customer is entitled to return an order within the period set by the Seller in its general terms and conditions of sale (in accordance with the 'right of withdrawal') to receive back the purchase amount, subject to the provisions of the four points below, under the conditions included in the general terms and conditions of sale of the relevant Seller:
      • The Customer has the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which the Customer acquires, or a third party other than the carrier and indicated by the Customer acquires, physical possession of the goods.
      • During this 14-day period, the Client will handle the product and the packaging with care, and will only unpack or use the product to the extent necessary to assess whether the Client wishes to keep the product. If the Customer exercises the right of withdrawal, the Customer shall return the product with all accessories supplied and - if reasonably possible - in the original condition and packaging to the Seller.
      • When returning products, the Customer must adhere to the Seller's Return Policy. The contact options, shipping and return policy of each individual Seller can be consulted at any time on the relevant Seller page on the Platform. This page is also linked from the order confirmation that the Entrepreneur sends the Customer by email with every order.
      • The Entrepreneur will then refund the purchase amount as soon as possible after the cancellation, but will wait to refund until the Seller has indicated that the product has been returned in good order - unworn and undamaged, with any attached price tag and / or stickers still on it - returned and the Seller accepts the return shipment. If the Customer has made use of his right of withdrawal in the prescribed manner, the costs of returning the product will be at the most. If the Seller also offers to bear the costs of the return shipment, this will be stated on the relevant Seller page on the Platform.
  2. If a Seller does not accept an order within two working days, the Entrepreneur will inform the Client within eight working days after the Client has placed the order that this order has not been accepted and return the payment already received by the Entrepreneur in this regard.
     

Article 9 - Information and use of data

  1. The Client will carefully monitor his email so that the Client can be informed in good time of information sent by the Entrepreneur to the Client.
  2. Entrepreneur is not liable for the late or unclear transmission of information or for obvious errors, regardless of who the information originates from or to whom this information is provided.
  3. The Client declares that he is aware of and agrees that his name and address details are provided to the Seller to the extent that these are necessary to implement the Purchase Agreement / order or if the Client has given his consent. The Seller is only entitled to make use of the data of the Customer insofar as this is necessary in the context of handling and executing the Purchase Agreement / order or if the Customer has given permission for the use of the data.
     

Article 10 - Miscellaneous

  1. Entrepreneur is entitled to restrict, not grant or revoke certain privileges or to block the use of the account or the possibility to order, deny or limit articles from Sellers through Entrepreneur, depending on the trade history of a trader Customer; this is exclusively at the Entrepreneur's discretion.
  2. If the Entrepreneur allows deviations from the Terms and Conditions, whether tacitly or not, for a short or longer period of time, this does not affect his right to demand immediate and strict compliance with the Terms and Conditions. The Client can never assert any right based on the fact that the Entrepreneur applies the Terms smoothly at any time.
  3. If one or more of the provisions of the Entrepreneur Conditions or of the procedural rules should conflict with any applicable legal provision, the relevant provision will lapse and it will be replaced by a new legally permissible provision to be determined by Entrepreneur, so much if possible taking into account the scope of the relevant provision.
  4. Entrepreneur is at all times entitled to no longer make the functionalities for the offer of Sellers on the Entrepreneur website available.
     

Article 11 - Applicable law

  1. The Terms and Conditions, the purchase / sale of items by Sellers via the Entrepreneur website and the Purchase Agreement between the buyer and the Seller are exclusively governed by Dutch law. All disputes between parties will be submitted to the competent court.
